Credit card providers can charge you for breaking your contract, but no more than the amount needed to cover their costs. If they make a profit from the charge, they are acting unfairly and you have the right to claim your money back; I want to help you do that.

Consumer Credit Act 1974 allows borrowers to challenge unfair credit agreements in court
The unfair provisions Section140A of the 1974 Act provides that a court may determine that the relationship between a lender and a borrower arising out of a credit agreement is unfair to the borrower because of:
- Any of the terms of the credit agreement or a related agreement
- The way in which the lender has exercised or enforced its right under the credit agreement or a related agreement or
- Any other thing done or not done by or on behalf of the lender either before or after the making of the credit agreement or a related agreement
- A breach in any of the above can make the agreement unfair and potentially unenforceable. This then allows the court to require the lender to refund the money to the borrower
A wrong put right, an unfair situation made fair
You as a consumer can challenge this yourself and take your dispute to the Financial Ombudsman Service. However this can be a long complicated, protracted ,confusing procedure.
